These Terms apply to the use of the Khan Home Digital Solutions (KHDS) website and our services. By using our website, accepting a proposal, approving work, or making payment, you agree to the applicable Terms. If acting for a company, you confirm you have authority to do so.

2. Services and Project Scope

KHDS provides software development, websites, e-commerce, cloud, DevOps, AI, automation, SEO, performance marketing, consulting, and related digital services. The exact scope, deliverables, timeline, and fees will be defined in the approved proposal, quotation, or service agreement.

3. Client Responsibilities

Clients must provide accurate requirements, content, access, approvals, and feedback needed for the project. Clients are also responsible for ensuring that any materials or data they provide can be used legally. Delays from the client side may affect timelines and costs.

4. Fees and Payment

Project fees, payment terms, deposits, and milestones will be stated in the relevant proposal or invoice. Third-party costs such as advertising spend, cloud services, software licenses, hosting, or domains are excluded unless specifically included. KHDS may pause work on overdue payments.

5. Timelines and Changes

Project timelines are based on the agreed scope and required client cooperation. Requests for additional features, platforms, integrations, or major changes may require revised fees and delivery dates. Approved work outside the original scope will be treated as a change request.

6. Intellectual Property

Each party retains ownership of its existing intellectual property, content, tools, and materials. Ownership or usage rights for final project deliverables will be governed by the agreed project terms. Third-party and open-source components remain subject to their respective licenses.

7. Confidentiality, Data and Security

KHDS and the Client will protect confidential information shared during the engagement. Client data and system access will be used only as needed to provide the agreed-upon services. Personal information will be handled in accordance with the KHDS Privacy Policy.

8. Third-Party Platforms, Ads, AI and Cloud

KHDS may use third-party platforms, including cloud services, advertising networks, analytics tools, APIs, and AI technologies. Their availability, policies, pricing, and performance are outside KHDS's control. SEO, advertising, AI, and marketing results cannot be guaranteed.

9. Warranties and Liability

KHDS will provide services with reasonable professional care and in accordance with the agreed scope. We are not responsible for indirect losses, lost profits, or business opportunities caused by factors outside our reasonable control. Any specific warranty must be stated in the project agreement.

10. Suspension and Termination

Either party may terminate an engagement in accordance with the agreed project terms. KHDS may suspend services for non-payment, unlawful activity, security concerns, or serious breach of agreement. Clients remain responsible for completed work and approved third-party costs.

11. Website Use, Governing Law and Updates

The KHDS website must only be used for lawful purposes. Unless otherwise agreed in writing, these Terms are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai, with disputes subject to the competent courts of Dubai. KHDS may update these Terms when necessary.
